1. About Pactly
Pactly is a digital platform that helps private individuals create, send and sign agreements online.
The service may be used for private agreements such as loan agreements, cohabitation agreements, rental agreements, purchase and sale agreements, simple partnership agreements and other agreements between individuals.
Pactly may offer the following features:
- uploading your own documents;
- creating agreements based on templates;
- generating draft agreements with the help of an AI assistant;
- inviting one or more parties to sign;
- electronic signing through available eID and signing providers;
- downloading the completed signed document.
Pactly is not a law firm and does not provide legal advice. Pactly is a technical platform for document flow, agreement templates and digital signing.
2. Who may use Pactly
You must be at least 18 years old to use Pactly.
By using the service, you confirm that:
- you have legal capacity to enter into agreements;
- you have the right to upload, send and sign the documents you use;
- the information you provide is correct;
- you will not use the service for illegal, harmful or misleading purposes;
- you have obtained any necessary consent or have another valid legal basis if you enter personal data about other people.
3. Use without a business account
Pactly may be used without creating a business account. You can create or upload a document, add the relevant parties, pay for the service and send the document for signing.
If Pactly later offers user accounts, business accounts, subscriptions, API access or team features, separate or additional terms may apply.
4. Signing process
A typical signing process in Pactly consists of the following steps:
- You upload a document or create a document in Pactly.
- You add the names and contact details of the parties who need to sign.
- You review the document and pay for the service, where payment is required.
- Pactly sends a signing invitation by email, SMS or another available channel.
- The parties open the signing link, read the document and sign using an available electronic ID or another signing method offered by Pactly.
- Once all required parties have signed, a completed signed document is generated.
- The parties can download or access the signed agreement.
Pactly may set a signing deadline. If not all parties sign before the deadline, the signing request may expire. An expired signing request may need to be created again.
5. Electronic signatures and legal effect
Electronic signatures may have legal effect under applicable law. Pactly may offer different signing levels depending on the available eID and signing providers.
The legal effect of an electronic signature may depend on the signing method, document type, parties involved, jurisdiction and requirements under applicable law.
Pactly may offer signing through Nordic and European eID solutions such as BankID, MitID, Swedish BankID, Finnish Trust Network or other providers, where available in the service.
Pactly does not guarantee that a specific eID solution will always be available in every country, for every user or for every document type.
Some documents may require a specific legal form, witnesses, physical signature, notarization, public registration or another formal process. You are responsible for assessing whether electronic signing is sufficient for the document you want to sign.
6. AI assistant and agreement templates
Pactly may offer an AI assistant that helps you prepare draft agreements based on the information you provide.
The AI assistant may suggest structure, wording and clauses, but the content may be incomplete, inaccurate or unsuitable for your specific situation.
Agreement templates and AI-generated content are provided as practical assistance only. They are not legal advice.
You are responsible for:
- reading the full agreement before signing;
- checking that all information is correct;
- assessing whether the agreement covers what you want to regulate;
- ensuring that all parties understand the content;
- obtaining legal advice where the agreement is important, complex or has financial consequences.
Pactly is not responsible for legal or financial consequences of agreements created, edited or signed through the service.
7. User responsibility for documents
The sender is responsible for the document sent for signing.
This means that the sender is responsible for ensuring that:
- the document is correct and complete;
- the document is not illegal, misleading or offensive;
- all invited signers have a genuine connection to the document;
- the document does not contain information that the sender has no right to process or share;
- the document is not used for fraud, coercion, identity theft or other improper behavior.
Each signer is responsible for reading and understanding the document before signing.
8. Price and payment
The price for Pactly is shown before payment. The price may depend on the number of signers, document type, signing method, AI features, SMS notifications, subscriptions or other selected features.
All prices are stated in Norwegian kroner or another currency shown in the payment window. If VAT applies, this will be shown in the price or payment summary.
Payment may be made through available payment solutions, such as card payment, Vipps, Stripe or other payment providers.
For one-time purchases, the service is normally considered delivered when the document has been prepared and sent for signing, or when the AI-generated document, document template or other digital feature has been made available to you.
Except for rights you may have under mandatory law, payments are not refunded if one or more signers choose not to sign, provide incorrect contact details, do not open the invitation or the signing deadline expires.
If the service cannot be delivered due to an error caused by Pactly, you may be entitled to a new delivery or a refund.
9. Right of withdrawal for consumers
If you are a consumer and purchase Pactly online, you may generally have a 14-day right of withdrawal under Norwegian consumer law.
If you request that the service starts before the withdrawal period has expired, you may be asked to consent to immediate delivery. If the service has been fully delivered with your express consent, and you have acknowledged that the right of withdrawal may be lost, the right of withdrawal may no longer apply.
If the service has only been partially delivered before you exercise the right of withdrawal, Pactly may charge you for the part of the service already delivered, where permitted by applicable law.
To exercise the right of withdrawal, contact us at support@pactly.no.
The right of withdrawal does not apply to purchases made as part of business activity.
10. Storage and download of documents
Once the signing process is completed, Pactly makes the signed document available for download in the service or through a link.
You are responsible for downloading and storing a copy of the signed document.
By default, signed documents may be available for download for up to 90 days after completed signing, unless another storage period is shown in the service. After this period, the document may be deleted or made unavailable.
Unsigned, expired or cancelled signing requests may be deleted earlier.
If Pactly offers user accounts or document archives, different storage periods may apply to documents that you choose to store in your account.
11. Security
Pactly works to protect documents, personal data and signing data through technical and organizational security measures.
These measures may include encryption, access control, logging, secure transmission, limited internal access, backup routines and the use of established providers for eID, signing, payment, hosting and communication.
You are responsible for protecting your email account, phone, eID, passwords and other login methods.
Pactly will never ask you to share your BankID password, one-time codes or other secret eID information directly with Pactly.
12. Personal data
Pactly processes personal data to provide the service, complete signing, handle payment, maintain documentation, provide customer support and comply with legal obligations.
More information about how Pactly processes personal data is available in our Privacy Policy.
13. Third-party providers
Pactly may use third-party providers for:
- electronic identification;
- electronic signing;
- payment;
- hosting and storage;
- email and SMS;
- analytics and error reporting;
- customer support;
- AI functionality.
These providers may have their own terms and privacy policies. Pactly is not responsible for errors, downtime or interruptions caused by third-party providers, unless otherwise required by mandatory law.
14. Prohibited use
You may not use Pactly for:
- illegal agreements or documents;
- fraud, identity theft or misleading signing processes;
- documents that violate the rights of others;
- processing or sharing personal data without a valid legal basis;
- uploading viruses, malware or technically harmful content;
- attempts to bypass security measures;
- spam, mass messaging or unwanted communication;
- harassment, coercion or misuse of other people;
- documents related to illegal activity.
Pactly may block, stop, delete or refuse signing requests if there is suspected misuse, security risk or breach of these terms.
15. Pactly's role
Pactly is a technical platform for creating, sending and signing documents.
Pactly is not a party to the agreements entered into between users. Pactly does not control whether an agreement is fair, valid, complete, balanced or suitable for the user's purpose.
Any dispute about the content of a signed agreement is a matter between the parties to that agreement.
16. Availability and changes to the service
Pactly works to provide stable and secure operation, but does not guarantee that the service will always be available without interruptions, errors or delays.
The service may be unavailable due to maintenance, technical issues, security incidents, provider issues or circumstances outside Pactly's control.
Pactly may change, improve or discontinue features of the service. Material changes affecting paid ongoing services will be communicated in a reasonable manner.
17. Errors and complaints
If the service does not work as agreed, contact Pactly at support@pactly.no.
Consumers may have mandatory rights under applicable consumer law. Nothing in these terms limits rights you have under mandatory law.
18. Limitation of liability
Pactly is not responsible for:
- the content of documents uploaded, created or signed by users;
- legal consequences of agreements between users;
- whether an agreement is suitable for a specific purpose;
- errors caused by incorrect or incomplete information provided by the user;
- losses resulting from a party not reading, understanding or complying with the agreement;
- a signer not signing before the deadline;
- downtime, errors or delays caused by third-party providers;
- indirect losses, lost profits or consequential damages.
Pactly's total liability is limited to the amount you paid for the specific service to which the claim relates, unless otherwise required by mandatory law.
19. Intellectual property rights
Pactly, including its name, logo, design, software, template structure, user interface, text, database, AI flow and other content, belongs to CMO Partners AS or its licensors.
You receive a limited right to use the service in accordance with these terms. You may not copy, resell, reverse-engineer, scrape, automate or otherwise exploit Pactly's technology or materials without written consent.
Documents you upload remain owned by you or by the person who owns the rights to the document.
20. Suspension and termination
You may stop using Pactly at any time.
Pactly may suspend, limit or terminate your access if you breach these terms, misuse the service, create a security risk or if suspension is necessary for legal or operational reasons.
21. Changes to these terms
Pactly may update these terms. The current version will be published on Pactly's website.
For new orders, the terms published at the time of the order apply. For ongoing signing requests, the terms in force when the request was created normally apply.
By continuing to use the service after new terms have been published, you are considered to have accepted the updated terms.
22. Governing law and disputes
These terms are governed by Norwegian law.
Disputes should first be resolved amicably. If a dispute cannot be resolved, it may be brought before the ordinary courts of Norway, with Oslo District Court as the agreed venue, unless mandatory law gives you the right to another venue.
Consumers may also have the right to complain to relevant consumer authorities.
